EU Commission opens public consultation on revision of the EU WEEE Directive
The European Commission has launched an online public consultation on the revision of EU WEEE Directive. The consultation focuses on the consistency of the Directive with the EU’s wider policy objectives, including those introduced under the European Green Deal and the Circular Economy Action Plan and any other relevant developments in EU environmental and waste policy.
Members are encouraged to respond to this consultation directly by 22 September if appropriate.
EP draft report on Commission proposal of February 2023 concerning a targeted amendment of the WEEE Directive
In January 2022, the Court of Justice of the European Union declared Article 13(1) of the WEEE Directive partially invalid due to non-justified retroactive effect. This ruling pertained to the financing responsibility of producers for the collection, treatment, recovery, and disposal of waste from photovoltaic panels placed on the market between August 13, 2005, and August 13, 2012. Following the Court’s ruling, in February 2023, the EU Commission proposed a targeted WEEE amendment to ensure compliance.
MEP Anna Zalewska, the Rapporteur of the European Parliament, intends to ensure the implementation of the Court’s ruling in the targeted WEEE revision. Her Draft report intends to provide clarity on the proposed changes.
