Dear members, please review the MedTech Europe update below on the Exemptions covered by the F-Gas regulation. Please send me any feedback. This legislation will impact CE marked goods including those placed on the NI market.
Dear members,
I hope you are all well.
We would like to inform you that the Commission exemptions for certain F-Gas uses (Annex IV) has been published in the EU Official Journal 23 October 2024 (attached).
The exemptions relate to those uses that would have been otherwise subject to a market ban as of 1 January 2025. The exemptions read as follows:
By way of derogation from Annex IV, point 4, to Regulation (EU) 2024/573, the placing on the market of the following equipment containing fluorinated greenhouse gases with a GWP of 150 or more is authorised from 1 January 2025 to 31 December 2028, provided they are labelled pursuant to Article 12(2) of Regulation (EU) 2024/573:
(a) environmental simulation devices consisting of a test chamber used to reproduce a variety of environmental conditions e.g. time-dependent temperature and humidity, for applications below – 50 °C;
(b) laboratory drying equipment used for the drying of liquid samples, by spray-drying or by freeze-drying;
(c) laboratory centrifuges used for separating fluids of different densities or liquids from solids in a rapidly rotating container.
This Regulation shall enter into force on the day following that of its publication in the Official Journal of the European Union (in view of the time constraints ahead of the 1 January 2025 ban) à 24 October 2024.
Members are invited to review carefully if their technology is captured by this language, specifically for those applications where the market ban would have been as of 1 January 2025, and let us know if there are any issues.
We would like to thank members for their work and efforts at national level to secure these exemptions and also supported by MedTech Europe at EU level.
