Please be kindly informed that the European Commission has published a Call for Feedback on a draft Delegated Act establishing rules on the calculation and verification of the weight of materials lost and not recycled after a waste sorting operation.
The draft Delegated Act is pursuant to Article 11a(10) of the Waste Framework Directive.
Next steps:
- The Call for Feedback is open from 17 February 2026 to 17 March 2026 EOD.
- Consequently, members are invited to share their input by Friday 27 February 2026 EOD.
For context:
The Waste Framework Directive establishes targets for the recycling of municipal waste to be achieved by 2025, 2030 and 2035. Currently, Member States must calculate these targets based on the input of waste into the recycling operation.
However, the Commission finds that there may be losses due to preliminary treatment before the specific waste materials enters the recycling operations, such as at waste collection. Additionally, the rules for the calculation methodology of waste collection are not uniform in the 27 member states.
This draft Delegated Act then seeks to establish a uniform methodology for the calculation, verification and reporting of the weight of waste materials which are removed from the sorting operation.
It is important to note that these rules will also have an impact on the calculation rates of the recycling targets of packaging waste under the Packaging and Packaging Waste Regulation. This is because:
- Recital 151 of the PPWR states that the same rules for the calculation established in Directive 2018/852/EU will apply. They are laid out in rates as Article 6a(3).
- Article 6a(3) of Directive 2018/852/EU in turn states that the calculation rules will be established by Article 11a(10) of the Waste Framework Directive.
- Article 11a(10) of the Waste Framework Directive empowers the Commission to adopt this draft Delegated Act.
