The EU have published their ‘right to repair’ directive. This is regarding consumer devices (listed in Annex II), with MDs and IVDs being out of scope. However we could see the scope widen in the future.
- Article 1
Subject matter, purpose and scope
- This Directive lays down common rules strengthening the provisions related to the repair of goods, with a view to contributing to the proper functioning of the internal market, while providing for a high level of consumer and environmental protection.
- This Directive shall apply to the repair of goods purchased by consumers in the event of a defect of the goods that occurs or becomes apparent outside the liability of the seller pursuant to Article 10 of Directive (EU) 2019/771.
- Articles 5 and 6 shall only apply to goods for which and to the extent that repairability requirements are provided for by Union legal acts listed in Annex II. 4. This Directive is without prejudice to Directive (EU) 2018/958.
