New EU active substance approval decisions
Apply for product authorisation by the deadline to keep your products on the NI market
Following evaluation under the EU BPR, a decision has been taken to approve the following active substance/product type combination. This will affect NI:
Action for biocidal product suppliers: If you want to supply biocidal products containing this active substance in the relevant product type, you can now apply for EU BPR product authorisation. Products must not be supplied in NI until product authorisation is granted.
Action for active substance suppliers: If you supply this active substance for use in biocidal products of the relevant product types, you may need to apply for technical equivalence. If you haven’t demonstrated technical equivalence for your manufacturing source, EU BPR product authorisation cannot be granted for biocidal products containing your active substance.

Upcoming EU active substance renewal submission deadlines
Apply for active substance renewal by the deadlines to keep products on the NI market
Under the EU BPR, active substance approvals will expire unless a renewal application is submitted at least 550 days before their expiry date.
The 550-day deadlines are coming up for the following active substance/product type combinations under EU BPR. This affects NI:
- (RS)-α-cyano-3-phenoxybenzyl-(1RS)-cis, trans-3-(2,2-dichlorovinyl)-2,2-dimethylcyclopropanecarboxylate (Cypermethrin) (CAS 52315-07-8 EC 257-842-9) in product type 08 (deadline: 28 November 2023)
- 1-[[2-(2,4-dichlorophenyl)-4-propyl-1,3-dioxolan-2-yl]methyl]-1H-1,2,4-triazole (Propiconazole) (CAS 60207-90-1 EC 262-104-4) in product type 09 (deadline: 28 November 2023)
- Carbon dioxide (CAS 124-38-9 EC 204-696-9) in product type 15 (deadline: 28 November 2023)
- 3-phenoxybenzyl(1R,3R)-2,2-dimethyl-3-(2-methylprop-1-enyl)cyclopropanecarboxylate (1R-trans-phenothrin) (CAS 26046-85-5 EC 247-431-2) in product type 18 (deadline: 28 February 2024)

Any person, company or task force/consortium can support an active substance/product type combination for renewal – it doesn’t have to be the original supporter. Check the EU Article 95 List to see who the original supporters were.
If any of these active substance/product type combinations are important to you, consider contacting your supplier to let them know.
If a renewal application is not submitted for the above active substance/product type combinations under EU BPR, the approvals will expire. This means the active substances can no longer be used in biocidal products of the relevant product types in NI.

ECHA public consultation: call for comments (Deadline: 10 November 2023)
The Great Britain Mandatory Classification and Labelling (GB MCL) process includes the consideration of information gathered from public consultations, conducted by HSE or international bodies such as the European Chemicals Agency (ECHA).ECHA has announced public consultations on the following proposals for harmonised classification and labelling (CLH):
- fluazaindolizine (ISO) (EC-; CAS: 1254304-22-7). Pesticide active substance. All hazard classes open for commenting;
- silver nitrate (EC: 231-853-9; CAS: 7761-88-8). Biocide active substance. All hazard classes open for commenting;
- thermally treated garlic juice (EC: -; CAS: -). Biocide active substance. All hazard classes open for commenting.

UK-based businesses with an interest in the proposal are strongly encouraged to share any relevant information.
Scientific and technical information should be submitted directly to ECHA using their commenting webform by 10 November 2023. Comments will be published on ECHA’s website.

Under the GB CLP Regulation, HSE will consider all published opinions of the Committee of Risk Assessment of ECHA (RAC) before publishing its own Agency Technical Reports and Agency Opinions, so any information you provide will be important in any final GB MCL decision.

GB active substance dossier submission deadline
Take action to keep your active substance in the GB Review Programme
The active substance/product type combination listed below has been successfully notified into the GB Review Programme following an open invitation. The next step is for a full active substance dossier to be submitted to HSE by the following deadline:
- 2,2-dibromo-2-cyanoacetamide (DBNPA) (CAS 10222-01-2 EC 233-539-7) in product type 02 (deadline: 16 November 2023)
Only the person, company or task force/consortium that successfully notified the active substance/product type combination listed above can submit a dossier. If any of these active substance/product type combinations are important to you, consider contacting the notifier to let them know. You may even be able to join them in supporting the active substance.

If a dossier is not submitted by the deadline, this active substance/product type combination will be subject to a GB non-approval decision. Biocidal products containing active substances with GB non-approval decisions for the relevant product types will have to be removed from the GB market. HSE will provide separate updates on these where relevant.
