Submit a notification by the deadline to keep active substances in the EU Review Programme
The European Chemicals Agency (ECHA) has published open invitations to provide an opportunity for a person, company or task force/consortium to notify an intention to take up or take over the role of participant in the EU Review Programme for the following active substance/product type combinations. This affects NI.
Anyone wishing to support one of the active substance/product type combinations listed below in the EU will need to submit a notification to ECHA by the following deadlines:
- Reaction products of 5,5-dimethylhydantoin, 5-ethyl-5-methylhydantoin with chlorine (DCEMH) (CAS n/a EC n/a) in product type 11 (deadline: 14 November 2024)
- Reaction products of 5,5-dimethylhydantoin, 5-ethyl-5-methylhydantoin with bromine and chlorine (DCDMH) (CAS n/a EC n/a) in product type 11 (deadline: 14 November 2024)
- Pyrithione zinc (Zinc pyrithione) (CAS 13463-41-7 EC 236-671-3) in product types 2 and 10 (deadline: 21 December 2024)
If a notification to take over the role of participant is not received, these active substance/product type combinations will be subject to an EU non-approval decision. Biocidal products and treated articles containing active substances with EU non-approval decisions for the relevant product types will have to be removed from the NI market. HSE will provide separate updates on these where relevant.

Biocidal products must be phased off the NI market
The active substance/product type combinations listed below are due to expire under the EU BPR on the following dates. This affects NI:
- Margosa extract from the kernels of Azadirachata Indica extracted with water and further processed with organic solvents (CAS 84696-25-3 EC 283-644-7) in product type 18 (deadline: 30 April 2024)
- Undecan-2-one (methyl nonyl ketone) (CAS 112-12-9 EC 203-937-5) in product type 19
(deadline: 30 April 2024)
- Methyl-benzimidazol-2-ylcarbamate (Carbendazim) (CAS 10605-21-7 EC 234-232-0) in product types 7 and 10 (deadline: 31 January 2025)
- Powdered corn cob (CAS n/a EC n/a) in product type 14 (deadline: 31 January 2025)
- Thiamethoxam (CAS 153719-23-4 EC 428-650-4) in product type 18 (deadline: 31 January 2025)
- 4-bromo-2-(4-chlorophenyl)-1-ethoxymethyl-5-trifluoromethylpyrrole-3-carbonitrile (Chlorfenapyr) (CAS 122453-73-0 EC n/a) in product type 8 (deadline: 30 April 2025)
Once the approval expires, the active substances can no longer be used in biocidal products or treated articles of the relevant product types in NI.
If you hold an affected EU BPR product authorisation or Control of Pesticides Regulations (COPR) product approval, we will contact you about cancelling or revoking your authorisation or approval. You will have an opportunity to submit comments or additional information and we will take account of these when finalising our decision.

Apply for active substance renewal by the deadlines to keep products on the GB market
Under the GB BPR, active substance approvals will expire unless a renewal application is submitted at least 550 days before their expiry date.
The 550-day deadlines are coming up for the following active substance/product type combinations under GB BPR:
- 2,3,5,6-tetrafluorobenzyl trans-2-(2,2-dichlorovinyl)-3,3-dimethylcyclopropanecarboxylate (Transfluthrin) (CAS 118712-89-3 EC 405-060-5) in product type 18 (deadline: 29 April 2024)
- 3-(N-acetyl-N-butyl)aminopropionic acid ethyl ester (Ethyl butylacetylaminopropionate (IR3535)) (CAS 52304-36-6 EC 257-835-0) in product type 19 (deadline: 29 April 2024)
- Lauric acid (CAS 143-07-7 EC 205-582-1) in product type 19 (deadline: 29 April 2024)
- methyl (E)-2-{2-[6-(2-cyanophenoxy)pyrimidin-4-yloxy]phenyl}-3-methoxyacrylate (Azoxystrobin) (CAS 131860-33-8 EC 603-524-3) in product types 7, 9 and 10 (deadline: 29 April 2024)

- Polyhexamethylene biguanide hydrochloride with a mean number-average molecular weight (Mn) of 1415 and a mean polydispersity (PDI) of 4.7 (PHMB (1415;4.7)) (CAS 1802181-67-4 / 32289-58-0 EC n/a) in product types 2 and 4 (deadline: 29 April 2025)
- Hydrogen peroxide (CAS 7722-84-1 EC 231-765-0) in product types 1, 2, 3, 4, 5 and 6
(deadline: 30 July 2025)
- N-((6-Chloro-3-pyridinyl)methyl)-N′-cyano-N-methylethanimidamide (Acetamiprid) (CAS 135410-20-7 EC n/a) in product type 18 (deadline: 30 July 2025)
Any person, company or taskforce/consortium can support an active substance/product type combination for renewal – it doesn’t have to be the original supporter.
Check the GB Article 95 List to see who the original supporters were. If any of these active substance/product type combinations are important to you, consider contacting your supplier to let them know. If a renewal application is not submitted for the above active substance/product type combinations under GB BPR, the approvals will expire. Apply for product authorisation by the deadlines to keep your products on the NI market
The following EU BPR active substance approval dates are coming up:
- Alkyl (C12-16) dimethylbenzyl ammonium chloride (ADBAC/BKC (C12-16)) (CAS 68424-85-1 EC 270-325-2) in product type 1 (deadline: 1 July 2024)
- Ozone generated from oxygen (CAS 10028-15-6 EC n/a) in product types 2, 4, 5 and 11 deadline: 1 July 2024)
If you supply biocidal products containing these active substances in the relevant product types, don’t forget to apply for EU BPR product authorisation by the dates above to keep them on the NI market.

Export and import of hazardous chemicals (PIC)
- Annual reporting of exports and imports of Prior Informed Consent (PIC) chemicals during 2023
Exporters and importers of PIC chemicals should submit data to HSE by 31 March 2024
Companies should now provide HSE with details of the quantities (in kilograms) of PIC chemicals they exported from GB or imported into GB during 2023 using the templates available on our website.
Annual reporting of quantities for the preceding year is required during the first quarter of each year under Article 10 of the GB PIC Regulation and includes movement of PIC chemicals to or from Northern Ireland (NI).
For EU exports and imports you do not need to indicate the specific EU country, however it would be helpful if you can indicate where the movement of the chemical was to or from NI.
The following are exempt from the reporting requirement and should not be included:
- special reference identification number (RIN) requests for exports in quantities not exceeding 10kg per year to each importing country for purposes of research or analysis
- imports for research and analysis in quantities not exceeding 10kg per year from any country
For mixtures and articles, report only the quantity of PIC chemical within the mixture or article.
If you did not export a particular PIC-listed chemical in 2023 for which you submitted an export notification, please respond to confirm this as a NIL return.
