On May 10, 2024, the Ukrainian government approved the Technical Regulation on the classification, labeling, and packaging of chemical products (“UA-CLP”). This regulation integrates the norms of the European CLP Regulation.
This regulation will enter into force after 6 months from the date of publication. The text of the regulation, including Annex VIII “Correspondence Table between EU CLP and UA-CLP” can be found here.
The new CLP Regulation in Ukraine will implement:
- European rules and criteria for the classification of chemicals and products across 33 hazard classes.
- Requirements for labeling and packaging of chemical products.
Before placing chemical products on the market, manufacturers, importers, suppliers, and other operators must gather all available information on the hazardous properties, assess the validity of this information, and classify the chemical according to the Regulation.
Additionally, economic operators must ensure that:
- The chemical products they produce, import, or supply in the Ukrainian market are classified for hazards according to the criteria of the Globally Harmonized System (GHS).
- Such chemical products are appropriately packaged and labelled with hazard information.
The Ministry of Environment has developed a draft Technical Regulation on the safety of chemical products (“UA-REACH), which is anticipated to be adopted by the government shortly.
