Please be informed that following its letter of formal notice in February 2023 and its reasoned opinion in November 2024, the European Commission has now decided to refer France to the Court of Justice of the European Union for failing to address the incompatibility of its labelling requirements concerning waste sorting instructions (“Triman Logo”) with Articles 34-36 of the Treaty on the Functioning of the European Union (TFEU).
The Commission considers that France is still in breach of EU rules as it did not take the necessary actions to remove the breach of EU law, i.e., the violation of EU Single Market principles.
While the judicial phase may still take time, this step marks an important milestone and the Commission’s renewed commitment to act as a guardian of the Single Market. In its press release, the European Commission explicitly highlights the recent Communication COM(2025)500 “The Single Market: our European home market in an uncertain world” and its commitment to removing barriers that significantly hamper the ability of European companies to benefit from the Single Market, for the benefit of the EU economy and consumers.
